Purchasing a commercial classed apartment

Hi. We are viewing an apartment with a view to purchasing it, that's officially recorded as a commercial property, as originally it was going to be a shop. Is this common and should we be worried about this. Thanks in advance Yvonne.

Hi Yvonne

These are the sort of things that can become a nightmare. We have friends who brought a property that was basically a garage and was registered as commercial, they are charged commercial taxes for the place and in the twenty odd years they have lived there they have never been able to register it as a private dwelling. It seems almost imossible to do what you would call a change of use. They (Tinajo) are quite happy that they live there but when it comes to sorting out the paperwork they seem to shrug there shoulders. And of course the taxes are higher for a commercial property. Just be very careful and get good advice from someone legal. Good luck.

Thank you. That's what we thought . We are getting advice from a independent  solicitor.

Well they have lived there for 20 plus years and pay taxes so if you like they turn a blind eye but if they try and sell it will be as a garage. Illegal to buy it no, but change of use with no permisions very probably.

Sadly yes my brother in law viewing one on Coronos and was told by his lawyer it could not be changed to residential after searches at the town hall - shame maybe the same one thx

Yes could be its on that  complex .so the solicitor  advised against  buying ye.

Well it is lovely my brother was mad keen I am sure he will share the information to save you expenses- allen 07793986990 it is a 2 bed apartment they have been letting no problem but after searches at the council it is impossible to change to residential- i think it is up with sue cox now for 145,000 euro - regards Sue Yates www.sueyatesvillas.co.uk can sell you a nice 8 days in ours Villa Victoria just 150 metre from Coronos
